Terms of Service

Please read these Terms of Service carefully before using the Gone Guided platform. These Terms govern your use of our website, mobile application, and all related services. By creating an account or making a booking, you agree to be legally bound by these Terms.
1. Acceptance of Terms
By accessing or using the Gone Guided platform ("Platform"), website, or mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform.
These Terms apply to all users of the Platform, including Clients (customers), guides (service providers), and visitors.
2. Eligibility
You must be at least 18 years old to use Gone Guided. By using the Platform, you represent and warrant that:
• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not barred from receiving services under applicable law
• All registration information you provide is accurate and complete
3. User Accounts
To access most features of the Platform, you must create an account. You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account
You may not create an account on behalf of another person without their express consent, or use another person's account.
4. Guide Services & Listings
Guides who list their services on Gone Guided agree to:
• Provide accurate, truthful descriptions of their trips, services, and qualifications
• Hold all required licenses, permits, and insurance required by applicable law
• Honor confirmed bookings except in cases of documented emergencies
• Maintain safe and professional conduct on all trips
• Comply with all applicable local, state, and federal regulations
Gone Guided is a marketplace platform. We are not a fishing guide ourselves and are not responsible for the acts or omissions of individual guides.
5. Bookings & Payments
When you book a trip on Gone Guided:
• Your payment is processed securely through Stripe
• A booking confirmation will be sent to your email
• The total amount charged includes the trip price plus any applicable platform fees and taxes
• Guides receive their payout after the trip is completed, minus the platform service fee
Cancellation by Angler: Cancellation policies vary by guide and are displayed on each listing. Gone Guided enforces the guide's stated policy.
Cancellation by Guide: If a guide cancels a confirmed booking, the angler will receive a full refund. Repeated cancellations may result in suspension of the guide's account.
6. Refund Policy
Refund eligibility depends on the cancellation policy set by the guide and displayed at time of booking. In general:
• Cancellations made well in advance (typically 72+ hours) may receive a full or partial refund
• Last-minute cancellations (within 24–48 hours) may not be refundable
• No-shows are generally not eligible for refunds
• If a guide cancels, the angler receives a full refund within 5–10 business days
To request a refund, contact support@goneguided.com within 7 days of the scheduled trip date.
7. Prohibited Conduct
Users of the Platform agree not to:
• Post false, misleading, or fraudulent content
• Circumvent the platform to arrange payments outside of Gone Guided
• Harass, threaten, or discriminate against other users
• Upload malware or attempt to interfere with the Platform's operation
• Scrape or copy Platform content without permission
• Use the Platform for any unlawful purpose
Violations may result in immediate account suspension or termination.
8. Intellectual Property
All content on the Gone Guided Platform — including text, graphics, logos, images, and software — is the property of Gone Guided, Inc. or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.
9. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. GONE GUIDED DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY GUIDE LISTINGS.
FISHING AND OUTDOOR ACTIVITIES INVOLVE INHERENT RISK. BY BOOKING A TRIP, YOU ACKNOWLEDGE AND ACCEPT THESE RISKS. GONE GUIDED IS NOT LIABLE FOR ANY INJURIES, LOSSES, OR DAMAGES ARISING FROM YOUR PARTICIPATION IN ANY GUIDED TRIP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GONE GUIDED'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN CONNECTION WITH THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.
10. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Austin, Texas, rather than in court.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice on the Platform. Your continued use after changes take effect constitutes acceptance of the revised Terms.
